For Voice Lessons with Emily’s Music Studio

Welcome to Emily’s Music Studio (“the Studio,” “we,” “us,” or “our”). By enrolling in lessons, purchasing any plan, or using our scheduling/purchase services, you (the “Student” or “you”) agree to the following terms and conditions (“Agreement”). If you do not agree, please do not enroll or schedule lessons.

1. Definitions & Scope

  • “Lesson” means a private 60-minute vocal coaching session (in-person or virtual, as offered).

  • “Monthly Subscription” means the recurring plan that provides four (4) Lesson credits per 30-day billing cycle.

  • “Billing Cycle” means the 30-day period from the date your subscription begins (or renews).

  • “Credits” means the Lesson slots provided under the Monthly Subscription which must be scheduled by you.

  • “Scheduling System” refers to our booking software (e.g. Acuity Calendar) which you use to book your lessons.

This Agreement governs all Students, regardless of plan type (single lessons, subscriptions, packages, etc.).

2. Monthly Subscription Terms

  • The Monthly Subscription grants you 4 Lesson credits per 30-day billing cycle.

  • The plan renews automatically every 30 days from the original start date, unless cancelled.

  • At the start of each new billing cycle, Credits reset to 4.

  • Unused Credits expire at the end of the billing cycle and do not roll over. Lessons must be scheduled before the upcoming billing date to be used.

  • The Monthly Subscription provides lesson credits, not a guaranteed weekly or standing time slot. Lessons are always subject to teacher availability and must be booked by you.

  • Subscriptions are non-refundable and non-transferable.

3. Scheduling, Rescheduling & Cancellations

  • All Lessons must be scheduled through the Scheduling System and are subject to availability.

  • You are responsible for managing your own booking and scheduling. The Studio does not guarantee a fixed time slot, nor does it “hold” a standing slot for you.

  • The Studio provides automated appointment confirmations and reminders. However, the Studio is not responsiblefor sending additional reminders about unused credits, remaining lessons, or scheduling gaps.

  • To cancel or reschedule a Lesson, you must give at least 24 hours’ notice.

  • Each Lesson may be rescheduled once, and ideally within the same billing cycle, though you may reschedule across to the next cycle if space allows.

  • Late cancellations (less than 24 hours’ notice) and no-shows result in the loss of that Lesson credit. No refunds or make-ups are available.

4. Subscription Cancellation & Expiration

  • You may cancel your Monthly Subscription at any time. Cancellation must be submitted through the Scheduling System or by contacting the Studio.

  • Upon cancellation:

    • Any Lessons scheduled beyond the unpaid renewal date will be automatically canceled.

    • Unused Credits expire at the end of the active billing cycle and cannot be carried forward.

  • Once expired, Credits cannot be restored.

  • The Studio is not liable for refunding unused credits or lessons.

5. Lesson Format & Delivery

  • Lessons may be offered in-person (currently only offered to New York City clients) or virtually (e.g. via Zoom) depending on what you purchase and what is scheduled.

  • For virtual Lessons: you are responsible for providing suitable equipment and a stable internet connection. You are encouraged to use settings optimized for music (e.g. “Original Sound for Musicians” on Zoom).

  • You are responsible for arriving on time. If you are late and do not notify the Studio, or if no contact is made within 10 minutes of the scheduled start time, the Lesson is considered a no-show and the credit is lost. Lessons that begin late due to the Student will still end at the originally scheduled time.

6. Student Conduct & Safety

  • While participating in Lessons, you must behave professionally and respectfully. The Studio reserves the right to terminate services if conduct is disruptive, abusive, or otherwise unacceptable — without refund.

  • You are responsible for your own physical and vocal health. Disclose any medical or vocal conditions prior to enrollment. The Studio is not liable for injuries, vocal strain, or health issues arising from lessons or practice.

  • All personal information, goals, and progress are considered confidential and will not be shared without your consent.

7. Payment, Refunds & No-Transfer Policy

  • Payment is due in full at the time of purchase or at each renewal for subscription plans.

  • All purchases (single lessons or subscriptions) are non-refundable.

  • Credits, lessons, and subscriptions are non-transferable — you may not gift or sell them to another person.

  • Under no circumstances will unused credits, missed lessons, or cancelled subscriptions be refunded or credited back.

8. Intellectual Property & Content Use

  • All materials, method content, lesson plans, or any proprietary content provided by the Studio during lessons remain the intellectual property of the Studio.

  • You may not reproduce, distribute, or use these materials for commercial purposes, or share them publicly, unless the Studio grants explicit written permission.

9. Disclaimers, No Guarantees & Limitation of Liability

  • The Studio makes no promises, guarantees, or warranties regarding any specific vocal progress, outcomes, skill level, or results. Results depend heavily on your own effort, consistency, and practice outside lessons.

  • The Studio provides lessons “as is.” You acknowledge that vocal progress varies, and past performance is not a guarantee of future results.

  • The Studio is not liable for any indirect, incidental, special, or consequential damages arising from use of its services — including loss of earnings, emotional distress, or other issues.

  • You understand and accept the risks associated with vocal training, including vocal strain, and agree to assume them voluntarily.

10. Changes to Terms & Conditions

  • The Studio reserves the right to modify or update these Terms & Conditions at any time.

  • Updated versions will be posted on the website with a new “Last Updated” date. Continued use of services after updates constitutes acceptance of the new terms.

11. Governing Law & Dispute Resolution

  • This Agreement shall be governed by and construed in accordance with the laws of the State of [Your State — e.g. New York], without regard to conflict of law provisions.

  • Any dispute arising out of or related to this Agreement will be resolved under the exclusive jurisdiction of courts in [Your County/State].

13. Acceptance

By enrolling, scheduling, or purchasing any plan via the Studio’s website or scheduling system, you confirm that you have read, understood, and agreed to all terms outlined above.
